Surveys, Analyses, or Evaluations

The District recognizes the importance of the privacy rights of our students and their parents. As such, no student may be required as part of the school program or District curriculum to participate or submit to any survey, analysis, or evaluation without prior written consent of the parent(s)/guardian(s), or student (if an adult or emancipated minor), if the survey, analysis, or evaluation reveals information regarding: 

  • Political affiliations or beliefs of the student or parent/guardian;
  • Mental or psychological problems of the student or student’s family;
  • Sex behavior or attitudes;
  • Illegal, anti-social, self-incriminating, or demeaning behavior;
  • Critical appraisals of other individuals with whom respondents have close family relationships;
  • Legally recognized privileges or analogous relationships, such as lawyers, physicians, and ministers;
  • Religious practices, affiliations, or beliefs of the student or parent/guardian;
  • Income, other than that required to verify eligibility for financial assistance. 

Parent/Guardian Inspection and Observation 

The parent(s)/guardian(s) shall be permitted to inspect all surveys, analyses, or evaluations mentioned above. To request inspection of the survey, a parent/guardian shall make a request to their building principal, who shall permit the parent /guardian to inspect the survey within a reasonable time. 

The parent(s)/guardian(s) shall be permitted to inspect all instructional materials used by the District in evaluating, surveying, or analyzing students in furtherance of an instructional program. Instructional materials shall include teacher’s manuals, films, tapes, or other supplementary materials. To request inspection of instructional materials, a parent/guardian shall make a request to their building principal, who shall permit the parent/guardian to inspect the instructional materials within a reasonable time. 

Parent(s)/guardian(s), in addition to the right to inspect all instructional materials, may, to a reasonable degree, be present at reasonable times to observe instructional activity in a class or course pursuant to Board of Education Policy 9410 – Parent(s)/Guardian(s) Visitation of Classrooms. 

Marketing 

The District shall not permit the collection, disclosure, or use of individually identifiable information (including names, addresses, telephone numbers, and social security numbers) collected from students for the purpose of marketing or receiving consideration for said information. 

Notice 

To ensure parent/guardian rights, the Superintendent or their designee shall notify parent(s)/guardian(s) in writing of any of the following: 

  • Any survey, analysis, or evaluation that may reveal the information contained in the first section of this policy;
  • The opportunity to opt their student out of participation in any survey, analysis, or evaluation that may reveal the information contained in the first section of this policy;
  • Any activities involving the collection of personally identifiable information collected from students for the purpose of marketing;
  • At least annually at the beginning of the school year, the specific or approximate dates during the school year when any surveys, analyses, or evaluations contained in the first section of this policy; and
  • At least annually at the beginning of the school year, and within a reasonable time after any substantive change to this policy, of the adoption and continued use of this policy.
